Welcome to the Odyssey Writing Application ("Odyssey", "the Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our writing platform, including any content, functionality, and services offered on or through the application.
Please read these Terms carefully before you start to use the Platform. By using the Platform, you accept and agree to be bound and abide by these Terms. If you do not want to agree to these Terms, you must not access or use the Platform.
1. Eligibility and User Accounts
1.1. Eligibility: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use the Platform. By using Odyssey, you represent and warrant that you meet all eligibility requirements.
1.2. Account Registration: To access certain features of the Platform, you may be required to register for an account via our third-party authentication provider (Auth0). You agree to provide accurate, current, and complete information during the registration process.
1.3. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
2. Subscription Tiers and Payments
2.1. Subscription Models: Odyssey offers various subscription tiers, including but not limited to Hobby, Standard, and Pro tiers. Each tier has specific features and usage limits (e.g., project creation limits).
2.2. Payment Processing: All payments are processed through Stripe. By subscribing to a paid tier, you agree to Stripe's terms and conditions and authorize us to charge your provided payment method for the applicable subscription fees.
2.3. Billing and Cancellations: Subscriptions are billed on a recurring basis (monthly or annually). You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing period.
2.4. Refunds: Except as required by law, subscription fees are non-refundable.
3. User Content and Intellectual Property
3.1. Ownership: You retain all ownership rights to the content you create, upload, or store on the Platform, including but not limited to books, chapters, notes, and blurbs ("User Content").
3.2. License to Odyssey: By posting or storing User Content on the Platform, you grant Odyssey a worldwide, non-exclusive, royalty-free license to host, store, transfer, and display your content solely for the purpose of providing the service to you.
3.3. Content Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary rights to use and authorize the use of your User Content.
3.4. Data Storage: User Content (such as chapter text) is stored in third-party cloud services, specifically Microsoft Azure Blob Storage. While we take reasonable measures to protect your data, we recommend maintaining your own backups.
4. Gamification and Rewards
4.1. Features: Odyssey includes gamification elements such as Experience Points (XP), Levels, and Streaks to encourage writing progress.
4.2. No Monetary Value: XP, Levels, Streaks, and any other virtual rewards provided on the Platform have no monetary value, cannot be redeemed for cash, and are non-transferable. We reserve the right to modify or discontinue gamification features at any time.
5. Prohibited Conduct
You agree not to use the Platform to:
- Violate any local, state, national, or international law.
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Infringe upon the intellectual property rights of others.
- Upload viruses or other malicious code.
- Attempt to gain unauthorized access to the Platform or its related systems.
6. Privacy
Your use of the Platform is also governed by our Privacy Policy and, where applicable, our GDPR Policy. By using Odyssey, you consent to the collection and use of your information as outlined in these policies, including data processed by our third-party partners such as Auth0, Stripe, and Microsoft Azure.
7. Termination
7.1. Termination by You: You may stop using the Platform at any time. Upon termination of your account, all of your personal data and User Content will be permanently deleted from the Platform within 30 days, subject to our data retention policies for legal and regulatory compliance.
7.2. Termination by Us: We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests. Upon such termination, your data will be handled according to our deletion policy.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ODYSSEY, ITS AFFILIATES, AND THEIR RESPECTIVE LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Changes to the Terms
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
